Privacy : SARL MBF is the owner of the site and of all the laws and rules related to it . The web site contents are protected by copyright. When not clearly provided, it is forbidden to copy, modify, download, transmit or deliver for distribution to third party for commercial aims the content of the web site, unless preliminary written acceptance by SARL MBF.

Orders : The present Selling General Terms rule the relations between SARL MBF and the Client in relation to the distance purchase of Products, through the net, on the site.

I. Acceptance of the general terms and conditions

The present general selling terms rule the agreed relations between Le p'tit marché de la Réunion and the client . It prevails over any other document unless previous specific written permission granted by Le p'tit marché de la Réunion .

The present general terms and conditions can be modified by Le p'tit marché de la Réunion without advance warning.

The applicable conditions will be those guaranteed on the site when the products are ordered .

II. Order

Your order is confirmed and prepared only after the amount has been debited and after Le p'tit marché de la Réunion has received all the following required elements

The subscriber or client is responsible for the up-to-date or when interested the rectification of his personal data .

Selling is concluded with the validation of payment : immediately debited if paid on line with your credit card or at reception of your cheque or transfer payment .

Le p'tit marché de la Réunion reserves itself the right to refuse or cancel any order from a client not in full accordance with its commercial politics .

III. TERMS OF PAYMENT

Prices given in euro are tax free prices .

Products prices presented on the site does not include transport charges.

Inclusive prices ( for France and EC countries ) including products prices, handling, packaging,storage, transport, insurance and commissioning charges are specified in the ordering form.

Products are to be paid cash with order.

Le p'tit marché de la Réunion reserves itself the right to modify parcels and products prices at every moment. Purchase prices are actually determined at the moment the order is registered .

You may order :

Paybox system is specifically designed to accept payments over the Internet .
The financial information ( credit card number , expiry date ) will be automatically forwarded to Credit Agricole bank through a cryptograph file that could not be acceded by Le p'tit marché de la Réunion or third party. When the card number has entered into a first level of control (key Luhn, oppositions, and so on.), the server PAYBOX SYSTEM emits an application for leave to the center of the bank which is affiliated to the merchant..This is achieved by using standardized protocols bank over a telecommunications specialist.

The authorization center of the bank returns a number authorization or denial. If payment is accepted, PAYBOX SYSTEM perform the following operations: - Display ticket payment on the screen of the buyer (optional) - sending the ticket payment by e-mail to the buyer and the merchant .
If payment is refused the buyer will be automatically informed by e-mail and the order cancelled.

The total amount of the order will be debited on the client current account , down payments are not possible and Le p'tit marché de la réunion reserves itself to charge interests ( for an amount of one and a half of the legal current interest rate ) if payments are delayed.

The total amount of the order will be debited on the client current account , down payments are not possible and Le p'tit marché de la réunion reserves itself to charge interests ( for an amount of one and a half of the legal current interest rate ) if payments are delayed.

IV. PRIVACY CLAUSES

In respect of French law of 12 May 1980 , Le p'tit marché de la Réunion owns the products ordered until the client has settled the total payment of them. In other case and for any other reason Le p'tit marché de la Réunion will use his right to require the immediate and total restitution of products at the client expense and own risks.

V. SHIPPING

At the moment of the shipment , you will receive an e-mail with your parcels data ( send date and reference ) as well as express couriers telephone numbers and websites references. You will find all relevant information at the following address :

We will try our best to check the conditions of shipment but ask you to undertake to check the shipment of your parcels as well.

VI TRANSIT TIME
Shipments are made by air .
Shipping time refers to the interval between the time the plane takes off from Réunion and the moment you have your parcel delivered at home , moment considered as the very delivery date even in case you can't take delivery of your products ( in your absence for example ).
Le p'tit marché de la Réunion will do his best to ship perishable products to the continent within 48 hours and undertake to meet a deadline of 72 hours except in case of force majeure .
Le p'tit marché de la Réunion strives to ship orders to EC countries or to any other countries within 72 hours..

Deliveries are made by independant contractors within agreed delays – 48 or 72 hours for packages less than 30kg , more than 72 hours for packages more than 30 kg.
Le p'tit marché de la Réunion will do his best to respect agreed delivery dates. Days are working days and do not include Saturdays, Sundays or bank holidays. Delivery times are given as a rough estimate and no reimbursement or any other damages can be required if delays occur except in case of excessive delays as mentionned in the article COMPLAINTS below .
We are not bound not to respect 48 or 72 hours delays after your order is confirmed . We work with lots of small suppliers and in case of assorments of varied products it may take delivery extra delay.
We mainly process shipments at the beginning of weeks .Some products ( flowers , fruit , salt meat ...) are only shipped on specific days . Departure days are given as reference and we reserve ourself the right to
expedite or delay a delivery for any inner causes and without prior notice.
Deliveries out of mainland France are submitted to delivery country laws and the subscriber undertakes to pay additional shipping charges due to products import ( custom duties, Value-Added Tax, sales tax ....).
All products ordered are reserved to personal use. Clients and subscribers are not allowed to sell whole or parts of the packages. Le p'tit marché de la Réunion cannot be held responsible for clients non payment of charges and tax duties.
In mainland France deliveries of your order is ensured by Colissimo so that you can track your packages.
In EC countries deliveries are ensured by Europe Colissimo or Chronopost services depending on the client preference For other destinations (Overseas and the International destinations, outside the European Union deliveries are ensured by international post services or Chronopost services depending on the client preference. Deliveries can be ensured in several times if all products are not available on time .
Deliveries are ensured the time that suits clients best and products are delivered by hand and counter signature or in case of absence hand over a person mandated .
In case of absence or inability to furnish your package (no guard your ,...), factor package files a notice of passage mentioning the date and address of the post office where you can pick up your package presentation of an identity document.
The possible deliveries charges are at clients expense. Clients are bound to check products conditions at reception. In case of damages clients have to express reservations on the delivery order and confirm them by registered mail within 3 days according to the article L133.3 of trade law . Clients have thus to mention damages due to shipping in a registered letter with acknowledgement of receipt within 8 days after reception of the package. No complaint will be taken into account in no respect of these required procedures.
In case of reception of packages which contents have been damaged ( damaged or frozen fruit or flowers )
we ask clients to send a digital photo on the JPG file format by e-mail to réclamation@lep'titmarché-de-laréunion.com .
Please note that we will make no reimbursement for damages caused by unpredictable weather conditions in Europe .

VIII. RETURNS

In accordance with article L.121.16 of the French code regarding consumption , the client has the right to return any products except perishable products within 7 days from the delivery of the package without having to pay a fee . The return right has to be exercised within the foretold term through the sending of an e-mail to service client@le'titmarché-de-laréunion.com or a letter ( Annie+fax).

As you choose products returned are either exchanged or reimbursed . You can yourself send back products but Le p'tit marché de la Réunion may organize shipping return for you . Return shipping charges are at your expense and we will take care to reimburse the amounts already paid net of shipping charges within one to three weeks.

IX. PRODUCTS WEIGHT

When you order , please be aware that the weight of products presented on line are approximative depending on packaging ( glass, metallic boxes , baskets , bags ...), cardboxes and other required shipping packaging elements.

IX. OFFERS EXPIRATION TIME

Le p'tit marché de la Réunion offers are subjected to avaibility. If a product of your package is out of stock we can replace it by a similar product of same range , same quality at equal price . In case return charges in relation with the client withdrawal right will be at Le p'tit marché de la Réunion expense .

XI. COMPLAINTS

In case you receive a package in which contents are defective please you must notify us in a maximum delay of :

• 2 days for perishable products or non perishable products showing a clearly visible defect when opening the package

• 30 days for perishable products showing a non visible defect when opening the package.

After checking and except on case of force majeure, in case Le p'tit marché de la Réunion , its suppliers or subcontractors responsability is clearly established, we will take care to replace the defective package or product and will write a credit memo you can use in case of forthcoming order. We may also reimburse defective package or products.

In case the delivery date exceed the deadline (for more than 3 weeks) the subscriber can have his order cancelled or reimbursed or can ask for a credit memo in a letter sent before the shipment of the package ordered.

In any case the client can pretend to any other forms of reparation except those stated in the present article.

XII. RECORDS OF SUBSCRIBERS USE AND ABUSE

Under the French law of January 6th 1978 addressing computing, files and personal information, clients whose personal data have been registered by Le p'tit marché de la réunion are entitled to access, modify, edit or delete any information refering to them. These information may be communicated to third party unless your preliminary written refusal.

XIII. APPLIED LAW

The present contract is submitted to the French law.

XVI FORCE MAJEURE CASE
Please note that Le p'tit marché de la Réunion will not be liable for any interruption of the contract due to causes beyond its control or any events which are likely to stop or prevent manufacturing or shipping of products including, but not limited to, the following: riots, strikes or other labor disputes; civil unrest; disruptions in air or ground transportation networks and natural disasters.

XIV. REGULATION

The products proposed by Le p'tit marché de la réunion and all matters related to his website is keeping with the French law.
If the need arises ,the foreign subscriber has to check if he is authorized to use products ordered in accordance with the law of his country.
Le p'tit marché de la Réunion declines to be responsible for non respecting regulations or law of the country where the products are delivered.
In case of any claims or any other problems, the litigation will be submitted to the competent related local courts.

XV .PROTECTION OF MINORS

Under the French regulation which stipulates that selling alcohol to minors under 16 is strictly banned the buyer undertakes to be over 16 when ordering on the site.

XVI. FORCE MAJEURE CASE

Please note that Le p'tit marché de la Réunion will not be liable for any interruption of the contract due to causes beyond its control or any events which are likely to stop or prevent manufacturing or shipping of products including, but not limited to, the following: riots, strikes or other labor disputes; civil unrest; disruptions in air or ground transportation networks and natural disasters.
